Terms of Service — Phoenix Quant Group (PQG)
1. Definitions
PQG / Phoenix Quant Group: provider of educational services, analysis tools, and behavioral feedback.
User: any natural or legal person who uses the website, platform, or services of PQG.
Services: education, trading analysis, behavioral feedback, journaling tools, demo environments, and related content.
Account: the user's personal access to the PQG platform.
2. Applicability
These terms of service apply to all use of the website, platform, and all services of PQG. By using PQG, the user fully accepts these terms. Deviations are only valid if agreed upon in writing.
3. Nature of services
PQG does not provide investment advice, individual trading advice, asset management, profit guarantees, or financial services within the meaning of supervisory legislation. PQG is an educational and behavioral analysis platform. All decisions are entirely the user's own responsibility.
4. No financial advice
All information, tools, feedback, and analyses are general in nature and intended for educational purposes only and do not constitute personal investment advice. Users act entirely at their own risk.
5. Demo and simulation environments
PQG may work with demo accounts, simulations, or fictitious scenarios. Results are not representative of real market conditions.
6. Liability
Phoenix Quant Group (PQG) is not liable for any direct or indirect damage, financial losses, missed profits, consequential damage, emotional or psychological consequences, technical malfunctions, data loss, or other damage arising from or related to the use of the website, platform, tools, content, feedback, analyses, or services of PQG.
To the extent that liability cannot be excluded under mandatory law, such liability is limited to the lowest legally permitted minimum, without any guarantee of compensation.
7. Use of the platform
Misuse, manipulation, copying, resale, or commercial use without permission is not permitted. PQG may temporarily or permanently block accounts.
8. Intellectual property
All content, methodologies, texts, and visuals are the property of Phoenix Quant Group, unless otherwise stated.
9. Subscription, term, and cancellation
The subscription is entered into for a recurring term as indicated during the checkout process. Non-use, losses, or changed circumstances do not entitle the user to termination or refund outside of the statutory right of withdrawal described in Article 10. The payment obligation remains fully in effect for the agreed period.
Users may cancel their subscription at any time via the Stripe billing portal. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are given for partial periods after the withdrawal period has elapsed.
10. Right of withdrawal
In accordance with Belgian consumer protection law (Book VI of the Belgian Code of Economic Law) and the European Consumer Rights Directive (2011/83/EU), consumers have the right to withdraw from a distance contract within 14 calendar days after the date of conclusion of the contract, without giving any reason.
To exercise the right of withdrawal, the user must inform PQG of their decision by a clear statement (e.g. via the contact form on the website or by email). The withdrawal period expires 14 days after the day on which the contract is concluded.
If the user has requested that the provision of services begins during the withdrawal period and subsequently exercises the right of withdrawal, the user shall pay an amount proportional to what has been provided until the moment the user informed PQG of the withdrawal, in comparison with the full coverage of the contract.
Refunds will be processed within 14 days of receiving the withdrawal notification, using the same payment method as the original transaction, unless the user expressly agrees otherwise.
11. Availability and changes
PQG cannot guarantee uninterrupted operation and reserves the right to modify or temporarily suspend services.
12. Third parties
PQG is not responsible for malfunctions or errors of external tools or platforms.
13. Privacy
Personal data is processed in accordance with the privacy policy and applicable GDPR legislation.
14. Applicable law
Belgian law applies to these terms. Disputes are exclusively submitted to the competent court.
15. Final provision
If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.
